DEFINITIONS
In the application and interpretation of this contract, the terms listed below shall express the meanings written next to them:
LAW: Law No. 6502 on the Protection of Consumers,
REGULATION: Distance Contracts Regulation (Official Gazette: 27.11.2014/29188),
SERVICE: Any consumer transaction subject, other than the provision of goods, performed or undertaken to be performed in return for a fee or benefit,
SELLER: A company that offers goods to consumers within the scope of its commercial or professional activities or acts on behalf of or for the account of such a provider,
BUYER: A natural or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes,
SITE: The Seller’s website hanjuwelier.com.tr,
PARTIES: The Seller and the Buyer,
CONTRACT: This contract concluded between the Seller and the Buyer,
PLATFORM: One or more websites used by the Seller for sales transactions,
GOODS: Movable items subject to purchase and intangible goods such as software, audio, video, and similar items prepared for use in an electronic environment.
SUBJECT OF THE CONTRACT
The subject of this contract is to regulate the rights and obligations of the Parties in accordance with the provisions of Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation, regarding the sale and delivery of the product(s) ordered electronically by the Buyer through the Seller’s website or mobile application named www.hanjuwelier.com.tr (“HanJuwelier”), which possess the characteristics specified in Article 3 of this Contract and whose sale price is indicated herein.
The Preliminary Information Form available on the HanJuwelier Platforms and the invoice issued upon the order placed by the Buyer constitute inseparable parts of this Contract. The Buyer, by purchasing products and services from the Seller, acknowledges, declares, and undertakes that they have read this Contract in its entirety, fully understood its content, and approved all its provisions.
The Buyer acknowledges and declares that they have read and been informed about all preliminary information, including the basic features and characteristics of the product subject to the contract, seller information, contact details, product sale price, delivery costs, payment method, delivery period, and delivery-related information on the HanJuwelier Platforms, that they have provided the necessary confirmation in the electronic environment, and that they will assume the payment obligation.
The Buyer acknowledges and declares that the products purchased, pursuant to Article 15/1-a of the Distance Contracts Regulation, are of the nature of “goods or services whose price varies due to fluctuations in financial markets and are not under the control of the seller or provider,” and therefore, except for the principles specified in Article 10, they do not have the right of withdrawal for purchases or service usage made through the HanJuwelier Platforms.
